Subscription to the Newsletter via the MailChimp Service

We send email newsletters only with the consent of the recipients or legal permission. When you subscribe to the newsletter, you will receive regular information and event announcements about the Reallabor Radbahn project.

In principle, the newsletter of our company can only be received by the data subject if (1) the data subject has a valid email address and (2) the data subject registers for the newsletter mailing. For legal reasons, a confirmation email will be sent to the email address entered by a data subject for the first time for newsletter dispatch using the double opt-in procedure. This confirmation email serves to verify whether the owner of the email address as the data subject has authorized the receipt of the newsletter.

The subscription to our newsletter can be cancelled by the data subject at any time. Consent to the storage of personal data that the data subject has given us for the purpose of sending the newsletter can be revoked at any time. For the purpose of revoking consent, a corresponding link can be found in each newsletter. Furthermore, the data subject can communicate this to the controller via kommunikation@radbahn.berlin.

Use and Application of MailChimp

The newsletter is sent using MailChimp, a newsletter sending platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.

The email addresses of our newsletter recipients are stored on MailChimp’s servers in the USA. MailChimp uses this information to send and evaluate the newsletter on our behalf. Furthermore, according to its own information, MailChimp may use this data to optimize or improve its own services, e.g. to technically optimize the dispatch and display of the newsletters or for economic purposes to determine from which countries the recipients come. However, MailChimp does not use the data of our newsletter recipients to write to them itself, nor does it pass them on to third parties.

Statistical Collection and Analyses

The newsletters contain a so-called “web beacon”, i.e. a pixel-sized file that is retrieved from the MailChimp server when the newsletter is opened. As part of this retrieval, technical information such as information about the browser and your system, as well as your IP address and time of retrieval are initially collected. This information is used for the technical improvement of the services based on the technical data, or the target groups and their reading behavior based on their retrieval locations (which can be determined with the help of the IP address), or the access times.

Statistical surveys also include determining whether newsletters are opened, when they are opened, and which links are clicked. For technical reasons, this information can be assigned to individual newsletter recipients. However, it is neither our intention nor that of MailChimp to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.

Use of the YouTube Plugin

Our website uses the YouTube plugin, a site operated by Google. YouTube videos that you can find on this page have been embedded through a no-cookie IFrame. This process is similar to a two-click solution, as the video does not start loading until you activate the play button. In this way, no cookies are stored, but a connection to YouTube’s servers is established. In this way, the YouTube server is told which of our pages you have visited. If you are logged into your YouTube account, YouTube can associate your Internet usage with your personal profile. You can prevent this by logging out of your YouTube account. Our use of YouTube is based on our interest in offering an attractive online presence and easily understandable content. Right of Withdrawal and Right of Objection

Irrespective of the aforementioned provisions, you have the right at any time (pursuant to Art. 7(3) and Art. 21 GDPR) to object to the use of your data and to revoke any previously given consent to the processing of your data. In case of revocation of consent to the processing of your data or the use of the data received, the lawfulness of the data processing cannot be challenged until the time of revocation.

Right to Rectification, Blocking and Restriction

In addition, you can request us to correct, block or delete the data we have collected (Art. 16, 17, 180 GDPR). We expressly point out that there may be legal obligations to continue storing data—in this case, the data can only be blocked.
